Objectives

This course deals with the conditions and scope of protection of trademarks, patents, designs et copyright. It also deals with the relationship with the law against unfair competition.

Contents

This course starts with a short introduction dedicated to the concept of intellectual property, common principles and the relationship with the law against unfair competition. It then deals (with numerous examples) with:

- trademark law (protectible trademarks, conflicts between trademarks, exclusive rights and exceptions, civil claims etc.) as well as other types of protection for distinctive signs: unregistered trademarks, tradenames, indications of origin, in particular

- patent law (with the emphasis on the conditions of patentability and scope of protection, but also license agreements and their drafting)

- design law (conditions and scope of protection)

- copyright law (protectible subject matter, exclusive rights and other prerogatives to protect the author's interests, exceptions and limitations, collective management by authors' societies, protection of performers, producers and broadcasters, some questions relating to Internet).

The course focuses on substantive law but neglects procedural aspects regarding filing formalities.
